Frequently asked questions
Will I get my visa immediately after submitting my application?
No, you will normally receive your visa 15 days after the submission of your application. The reason for this is that after submitting your application you will get an ‘Under Consideration stamp’ in your passport. The Immigration Officers will use this time to go through and check your application. After 15 days, you go back to the Immigration Office and collect your visa.
What happens if I get divorced?
In the event of a divorce, your Non-Immigrant O Marriage Visa will become invalid and you will be required to leave Thailand immediately.
If you have an extension of stay based on marriage, you will need to go to the Immigration Office and cancel the extension. Upon cancellation, you will be given a 7 day stamp in your passport and be required to leave Thailand.
If you qualify for a Non-Immigrant B (Work) Visa or a Retirement Visa, you can apply for/change your visa to one of these.
Are there any restrictions to consider when applying for a marriage visa?
Once you have received your marriage visa, you are allowed to stay in Thailand for one year. You are allowed to undertake employment while on this type of Visa. You must report to Immigration every 90 days to verify your current address.
How do I prove I have satisfied the financial requirements?
If using a security deposit, you will need to show an updated passbook/bank book which is in your name and from Thai bank. A letter from the bank clearly stating that at least THB 400,000 baht was deposited in your account from an overseas source, and has been cleared at least 2 months prior to the date of your retirement visa application is also required.
If using monthly income, you will need to provide a 12-month bank statement showing a regular monthly deposit of THB 40,000 into a Thai bank account. You will also need a certified bank letter from your Embassy in Thailand.
Can I leave and re-enter Thailand?
If you hold a multiple entry Visa, you can enter and leave Thailand as many times as you like during the validity of your Visa.
If you possess a single entry visa or an extension of stay based on marriage, you will need to obtain a re-entry permit. Re-entry permits can be obtained from the Immigration Office.
Do I need a Work Permit to work, having a Marriage Visa?
A Non-Immigrant O Visa itself does not allow you to work in Thailand, but it does allow you to apply and obtain a work permit. Please note, it is illegal to work in Thailand without a work permit.
