Work Permit

A work permit allows a non-Thai citizen to legally work and operate a business in Thailand. Work permits can be obtained by both skilled workers and standard employees and are a mandatory requirement in order to be able to work in Thailand.

What is a Work Permit?

A work permit is a legal document which clearly states a foreigner’s position, occupation, or job description and the name and details of the Thai company they will be working for. It also acts as a license to perform a job/occupation for a foreigner in Thailand.

Foreigners who enter Thailand are not permitted to work (regardless of the Visa they hold) unless they have applied for and received a valid work permit. Those who wish to work in Thailand must hold the correct type of Visa, a Non-Immigrant B Visa, to be eligible to apply for a work permit.

Individuals may only work for the company listed on the work permit. This is because the work permit is issued to the employee for the specific company and location only.

• Duration of stay

Depending on the program chosen, holders can stay in Thailand for 5, 10 or 20 years.

• Financial Requirements

N/A

• 90 Day Reporting

If you stay in Thailand for >90 days, you must submit a 90 day report at the local Immigration Office. Thailand Elite staff can file your report on your behalf.

• Leaving and re-entering Thailand?

Thailand Elite Visas are multiple entry.

• Is employment permitted?

Holders of a Thailand Elite visa are not permitted to work.

• Further requirements

Applicants must satisfy the following the following:

  • Have no overstay in Thailand.
  • Be at least 20 years old
  • Have no criminal history

Frequently asked questions

Does a foreigner who works in Thailand but has his salary paid by the parent company outside Thailand need a work permit?

Yes, because the person in question is working in Thailand. It doesn’t matter where the money comes from, all foreigners working in Thailand must have a valid work permit unless exempted.

What happens if I quit my job?

In the event of you leaving your job, you must surrender your work permit to the Labor Department no more than 10 days after leaving your position.

Can a foreigner start working after submitting an application for a work permit?

No, it is not possible to start working until a full work permit has been granted, unless the employee is working for a business promoted by the BOI (Board of investment).

Can a foreigner work 2 different jobs in Thailand?

Yes, however, the employee will need to submit a new work permit application for each additional job. The new job details will be added to the existing work permit book.
