Once an agreement has been reached, the parties must register the divorce and terms with the local Amphur (district office).<\/p>\n<p>Contested divorces are where you cannot agree with your spouse on the terms of divorce. If you got married in a country outside of Thailand and your prenuptial agreement was registered in that country, it can still be enforced by a Thai court provided that is consistent with the foreign law.<\/p>\n<p>Under Thai law, the following basic requirements must be satisfied when creating a prenuptial agreement.<\/p>\n<ul>\n<li>The agreement must be in written form.<\/li>\n<li>Each party must be represented by his or her own attorney.<\/li>\n<li>The prenuptial agreement must be signed by each party and two witnesses (who are at least 18 years old). This must be done when the marriage is registered.<\/li>\n<li>The prenup must be registered at the same local office where the marriage is registered.<\/li>\n<\/ul>\n<p>A prenup allows the couple to handle the division of marital property discreetly and privately. Once a settlement has been reached, it will be filed with the district office (where the divorce is granted).<\/p>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-e12zid-d22067e9a092c14eba134a63127ae230\">\n#top .hr.hr-invisible.av-e12zid-d22067e9a092c14eba134a63127ae230{\nheight:30px;\n}\n<\/style>\n<div  class='hr av-e12zid-d22067e9a092c14eba134a63127ae230 hr-invisible  avia-builder-el-22  el_after_av_textblock  el_before_av_textblock  av-medium-hide av-small-hide av-mini-hide'><span class='hr-inner '><span class=\"hr-inner-style\"><\/span><\/span><\/div><br \/>\n<section  class='av_textblock_section av-2581ji-5d293ba7590494d5717238c3c17cc694'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock h2_bleu_post'  itemprop=\"text\" ><h2>Property Types in Thailand<\/h2>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-kyl08l2f-a865c6afd2e6913cc9381857517bcf03'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>There are two distinct property types in Thailand in relation to marital property:<\/p>\n<p>SIN SUAN TUA &#8211; separate property to a marriage:<\/p>\n<ul>\n<li>Property belonging to either spouse before marriage;<\/li>\n<li>Property for personal use, clothes or ornaments;<\/li>\n<li>Property acquired by either spouse during marriage by will or gift;<\/li>\n<li>Khongman (dowry).<\/li>\n<\/ul>\n<p>SIN SOMROS \u2013 marital property:<\/p>\n<ul>\n<li>Property acquired during marriage;<\/li>\n<li>Property acquired by either spouse during marriage through a will or gift;<\/li>\n<li>Earnings from the Sin Suan Tua (e.g. income from renting an inherited property);<\/li>\n<\/ul>\n<p><strong>Please note<\/strong>, that if there is any doubt as to whether a property is Sin Somros or not, it will be presumed to be Sin Somros (Section 1474 of the Civil and Commercial Code).<\/p>\n<p>Additionally, for example, if you were to buy a car during your marriage and you pay for the car with personal money (not marital) the car would be considered a personal asset of the spouse who paid for it (ONLY if the car was paid with personal property), even though it was acquired during the marriage (Section 1472 of the Civil and Commercial Code)<\/p>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-38vaya-d4a0975981dce01109006d37b98287ae\">\n#top .hr.hr-invisible.av-38vaya-d4a0975981dce01109006d37b98287ae{\nheight:30px;\n}\n<\/style>\n<div  class='hr av-38vaya-d4a0975981dce01109006d37b98287ae hr-invisible  avia-builder-el-25  el_after_av_textblock  el_before_av_textblock  av-medium-hide av-small-hide av-mini-hide'><span class='hr-inner '><span class=\"hr-inner-style\"><\/span><\/span><\/div><br \/>\n<section  class='av_textblock_section av-kyl1ezad-2645495a21a18722a21f5c14ac435ad5'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock h2_bleu_post'  itemprop=\"text\" ><h2>How are assets divided during a divorce in Thailand?<\/h2>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-8pzyk-31262c0feeaa086f9f0b326a91be6013'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>A 50-50 division of the Sin Somros is the most common divorce settlement. One potential sticking point could be the houses and vehicles that couples have purchased during their marriage. These items could be a sticking point as they cannot be literally split in half and the resulting shares being given to both parties. Therefore a compromise must be met in order to reach a divorce settlement.
