As part of this update, Kratom (Mitragyna speciosa), was removed from the list of prohibited substances. This amendment also decriminalised Kratom related offences such as the consumption and possession of Kratom.<\/p>\n<p>On August 27, 2022, the Kratom Plant Act B.E. 2565 (2022) came into effect. This act has been designed to encourage economic activity related to Kratom, by regulating the trade, sale, consumption, study, and advertising of Kratom leaves (alone or as an ingredient in food) in Thailand.<\/p>\n<\/div><\/section><\/p><\/div><div class='flex_column av-bmm5w-737f28be9bb008277e27311ae0eaf479 av_one_half  avia-builder-el-11  el_after_av_one_half  avia-builder-el-last leaves<\/h2>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-8ohy4-ba2bc652f51fc02aca7b4faa3ec86cd2'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>The Kratom Plant Act states that importing and exporting Kratom leaves without obtaining a licence from the secretary-general of the Narcotics Control Board (NCB) is prohibited.<\/p>\n<p>The following groups are eligible to receive a licence from the NCB:<\/p>\n<ul>\n<li>Thai nationals over twenty years old and residing in Thailand;<\/li>\n<li>Juristic persons registered under Thai law;<\/li>\n<li>Community enterprises under the law; and<\/li>\n<li>Government agencies.<\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l8bcqzyk-8360177f4b73c0aac9f3cc665c4947c3'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>Once granted, a licence is valid for five years. It is important to note that even though a licence has been granted, importers and exporters must still notify the NCB when importing or exporting Kratom leaves.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l8bcr8rj-42bb6977bac87ead29f57c40908fbf5a'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>However, taking Kratom leaves in and out of Thailand for personal consumption, therapy, and treatment of an illness would be exempted from the requirements mentioned above. Any Kratom leaves taken for international travel must be in accordance with the allowance specified in any relevant ministerial regulations. The following activities are considered as &#8216;selling&#8217; under the act:<\/p>\n<ul>\n<li>selling,<\/li>\n<li>dispensing,<\/li>\n<li>distributing,<\/li>\n<li>exchanging,<\/li>\n<li>or giving the substance to others.<\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l6k8wpjr-6d85be62a91472dc20f45c2a1f948452'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>The Kratom Plant Act prohibits the sale of Kratom leaves (or food that contains kratom leaves as an ingredient) to:<\/p>\n<ul>\n<li>anyone under 18 years old, and<\/li>\n<li>pregnant or breastfeeding women.<\/li>\n<\/ul>\n<p>The Kratom Plant Act also allows the Ministry of Justice and the Ministry of Public Health to prohibit selling Kratom to additional persons at a later date.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l82rrsbe-72da2eebe6bd17ee09042733d749c9c3'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>Any one who sells Kratom must post an announcement at their place of sale (including electronic points of sale) stating that the groups listed above are prohibited from purchasing Kratom. Anyone caught selling Kratom to these groups or failing to post the required announcement or notice could be subject to a fine of up to THB 30,000.<\/p>\n<p>These measures are intended to protect people from the potential harm of consuming or misusing Kratom.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l8bctpfb-35f4e775cec067b791ef32450748b19d'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>Please note that selling Kratom to the restricted groups above may be allowed only if done for medical or educational purposes. The exception to this being when done for the specific medical or education purposes given above. Under the Act, the advertising or promotion of the consumption of Kratom leaves mixed with narcotics or psychotropic substances, drugs and dangerous substances, or other designated substances is prohibited. This regulation covers advertisements or any type of marketing communications such as:<\/p>\n<ul>\n<li>public relations,<\/li>\n<li>news,<\/li>\n<li>publishing promotion,<\/li>\n<li>point-of-sale displays,<\/li>\n<li>direct marketing,<\/li>\n<li>sales,<\/li>\n<li>and online or computer advertising.<\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l82rvih4-5c78b14477978abcecb87724c0fad2bd'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>Any form of advertising or promotion which violates the Act is subject to imprisonment for a period of up to two years, a maximum fine of THB 200,000, or both.<\/p>\n<p>Furthermore, anyone or any advertising\/promotion that aims to convince others (including \u201cencouraging, deceiving, intimidating, improperly influencing, or forcing\u201d) to consume Kratom leaves mixed with narcotic drugs, psychotropic substances, dangerous substances, or other designated substances is also prohibited.
