These plans have been introduced in order to protect investors and the public against fraud.<\/p>\n<p>The upcoming regulation comes at a time when the SEC is continuing to tighten its rules governing digital asset businesses. The draft regulation is currently undergoing the public hearing process until October 17, 2022.<\/p>\n<\/div><\/section><\/p><\/div><div class='flex_column av-bmm5w-737f28be9bb008277e27311ae0eaf479 assets and lending or investing those assets and then offering returns made on such transactions to depositors.<\/li>\n<li>Digital asset operators will also be prohibited from advertising or encouraging others to offer deposit and lending services.<\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-kscytnto-6f8bd4ca8aa4b5f4311495ee3b7802c6' regulation?<\/h2>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-8ohy4-ba2bc652f51fc02aca7b4faa3ec86cd2'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>Under the proposed regulation from the SEC, digital asset operators will be prohibited from taking deposits in the form of digital assets and lending or investing those assets and then offering returns made on such transactions to depositors.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section ><p>Therefore, digital asset businesses will not be allowed to offer returns to depositors of digital assets, without using the asset for investment or seeking other benefits. However, any revenue gained from a sales promotion in accordance with the SEC&#8217;s rules is allowed.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l93y88bc-c308e3bd63d0072a2c9600f6863822bc'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>Also, the regulation will prohibit digital asset operators from advertising or encouraging others to offer deposit and lending services. For example, the companies must act as a channel for their clients to use deposit and lending services abroad via their platform or application.<\/p>\n<\/div><\/section><br \/>\n\n<style exceptions will apply to the following events:<\/span><\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Depositing of the digital assets as a consensus mechanism such as Proof of Stake (PoS) in case that the digital assets business operator operates as a blockchain developer.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Giving or transferring the digital assets to the customer in case that the digital assets business operator receives such digital assets via hard fork, soft fork, or air drop from the digital asset issuer.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Transferring the digital assets by the order of the customer without utilising the benefits of such assets.<\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section aria-level=\"1\"><span style=\"font-weight: 400;\">Providing general information for DeFi platforms without any using any terms to tactics to encourage the use of such a platform<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Engaging in the scope of activities as authorised in the companies digital asset licence.<\/span><\/li>\n<\/ol>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-8iju8g-712dbd91ef927a4e2dfc837a757ed696\">\n#top
