However, should the dismissal be made without a statutory cause, as provided under the Labour Protection Act B.E. 2541, the company could be liable for statutory payments to be made to the employee, for example, severance pay, wages to the last working day and any unused vacation days.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this article, we take a look at the process for h2_bleu_post'  itemprop=\"text\" ><h2>What are the statutory causes for the dismissal of an employee in Thailand?<\/h2>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-8ohy4-ba2bc652f51fc02aca7b4faa3ec86cd2'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">Thai law sets out several statutory causes that a company can rely upon when dismissing an employee.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Section 583 of the Civil and Commercial Code states that the following can be considered statutory causes for the termination of an employee who:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">wilfully disobeys or habitually neglects the lawful commands of the employer,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">absents himself of services,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">guilty of gross misconduct,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">or otherwise acts in a manner incompatible with the due and faithful discharge of the employee\u2019s duty.<\/span><\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-la9e8nmk-649f5b68c962609265d18ebf1ab699a3'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">In addition, Section 119 of the Labour Protection Act also stipulates the statutory causes as follows:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">performing the duty dishonestly or intentionally committing a criminal offence against the employer;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">wilful acts were done to cause damages to the employer;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">committing negligent acts causing serious damage to the employer;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">violating work regulations, regulations or orders of the employer which is lawful and just for which the employer has already issued the employee a written warning, except in a serious instance for which the employer is not required to give a warning;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">absenting from duty without justifiable reason for three (3) consecutive working days whether or not they are separated by holiday and;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">being sentenced to imprisonment by a final court judgment. <\/span><\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-la9e96ag-dacd841a94238fff9b411c554ac9df0e'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">Therefore, should an employee perform an action or deed which satisfies the above requirements, the employer can terminate the employee\u2019s employment using statutory causes. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, should the employer terminate an employee using a statutory cause, the employer is required by the law to notify the reason for the termination through the issuing of a letter of termination of employment. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Alternatively,\u00a0 a company may inform the reason for termination to the employee at the time of the termination of employment. This is required in order for the termination to be effective on the day of the next and final wage payment for the employee.<\/p>\n<p>Essentially, the dismissal notice from the employer must be sent to the employee in advance by at least one cycle of wage payment. Unfair dismissal cases can be brought before the Labour Court even though the employer has made all the required payments, i.e. wages until the last working day, severance payment, payment in lieu of advance notice, and wage for unused annual leave.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labyhrck-685f2f53592408f36f4610039462ee67'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">Should the Labour Court view that the termination of employment is unfair, the Labour Court may order the employer to re-employ the employee. However, the Labour Court may have the opinion that the employee and the employer cannot work together anymore. If this is the case, the Labour Court may order the employer to pay extra compensation i.e. compensation for unfair termination to the employee.\u00a0<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labyi2i2-a954560e3479949ec6fc69a94383a68e'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">The Labour Court will come to a judgement on the amount of compensation owed by taking the following into consideration:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the employees\u2019 age<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Period of employment\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">payment for unused annual leave\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">compensation for Unfair Termination and hardship and\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the reason for dismissal<\/span><\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labyia43-0582a7595d395230506fa89353b1b2ea'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">Typically, the court normally will grant compensation for unfair termination by determining the employee&#8217;s service years at the rate of one month per one service year of the terminated employee. This notice should be provided in written form and contain all the termination details, the reason for termination and the date of dismissal. <\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labyk89h-b46d501375a21b523955ef9bb1bd44d3'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock h2_bleu_post'  itemprop=\"text\" ><h3>Notifying the employee of the termination in advance<\/h3>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-la7zbx2l-1d49b38166e2b61aaefddc1e710e161c'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">According to Section 17 of the Labour Protection Act, the dismissal notice must be sent to the employee in advance at least one cycle of wage payment. Failure to do so means the employee will be able to claim compensation in lieu of the advance notice.\u00a0<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labykxn3-205146268d036a61bb93c804227d5406'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock h2_bleu_post'  itemprop=\"text\" ><h3>Paying the required statutory payments<\/h3>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labyl5b0-729a37ff46d6ca0dd63924de58164623'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">The Labour Protection Act states that the employer has to pay wage and overtime payments within three days after the dismissal date. While any other compensation that is owed such as severance pay, payment in lieu of advance notice, payment for unused annual leave and others has to be paid upon the dismissal date. <\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labylf3m-7cb1032e204b9f26a9aec4ae4332c6c7'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock h2_bleu_post'  itemprop=\"text\" ><h3>Issuing of the withholding tax certificate<\/h3>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labylmj6-7f6588686d22da9bef4145f9672ccdf6'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">As per the Revenue Code, the employer must issue a withholding tax certificate for the compensation paid to the employee upon deduction of the withholding tax from the compensation derived from the dismissal.\u00a0<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labylzkb-759941e3564e140bf3a22057ec877097'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock h2_bleu_post'  itemprop=\"text\" ><h3>Issuing a job certification<\/h3>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labym707-560a22c5acdbbe035d85d75665f3751c'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">Section 585 of the Civil and Commercial Code states that upon being asked by the employee, the employer has to issue the job certificate showing the length of their service years working for the employer and information relating to the nature of their work.\u00a0<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labymkab-667a416863d69e4297da3ffe729cebc4'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock h2_bleu_post'  itemprop=\"text\" ><h3>Closing the provident fund (if any)<\/h3>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labyms0l-9d2f4b98f904e7ce9618e1564d32f7a4'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">The employer has to notify the fund manager of the dismissal. The fund manager will then pay out the fund to the employee according to the Articles of Association of the fund within a period of 30 days after the date of membership termination.<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labyn2t9-49b7591f7def8266a78e072833d29103'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock h2_bleu_post'  itemprop=\"text\" ><h3>Returning the employer\u2019s belongings<\/h3>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-labyn9ns-db4e51b00f8ce6013833221398cb2df9'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">In relation to the employer\u2019s belongings i.e. uniform, ID card, health insurance etc., returning such items is subject to the employment contract. Typically these items will be returned to the Company on the last working day.<\/span><\/p>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\"
