In this situation, an employer must stick to the following procedure.<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-lfgnk24n-ba2acafce6b945d7f96536fa41655f1c'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The employer must provide a written notice of termination that includes relevant details such as the reason, date, and terminal information.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To be effective from the following wage payment date, a written notice needs to be provided by the due date of wage payment, as per section 17 of the Labour Protection Act.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">After the termination date, the employer must pay statutory wages and overtime pay within three days. Furthermore, severance pay, reimbursement for unused vacation time, and payment in lieu of advance notice should be paid on the day of termination.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Per the Revenue Code, the employer must provide the withholding tax certificate for the compensation paid to the employee after deducting the withholding tax from compensation derived from the termination.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">According to section 585 of the Civil and Commercial Code, if requested by the employee, the employer must issue a job certificate containing the employee&#8217;s work history and the number of years worked for the company.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The employer must inform the fund manager of the employee&#8217;s termination, as per section 23 of the Provident Fund Act, so that the fund can be paid out to the employee in compliance with the fund&#8217;s Articles of Association within 30 days of the membership termination date.<\/span><\/li>\n<\/ol>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-649b0e-50a8b59d6472fe9ba7b5e0d211b2e710\">\n#top .hr.hr-invisible.av-649b0e-50a8b59d6472fe9ba7b5e0d211b2e710{\nheight:30px;\n}\n<\/style>\n<div  class='hr av-649b0e-50a8b59d6472fe9ba7b5e0d211b2e710 hr-invisible  avia-builder-el-30  el_after_av_textblock  el_before_av_textblock  av-medium-hide av-small-hide av-mini-hide'><span class='hr-inner '><span class=\"hr-inner-style\"><\/span><\/span><\/div><br \/>\n<section  class='av_textblock_section av-lezdvgsq-6e3e512aed92c5e125197232e9b4593f'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock h2_bleu_post'  itemprop=\"text\" ><h2>What is the notice period for firing an employee?<\/h2>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-lezdvugg-68624e9d0f5e1cbb9aa84cb627635cfa'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">Employers must give employees a notice period of at least one pay cycle before termination. Unless a provision in the employment contract specifies a longer notice period, the notice period should be at most three months. The employer must adhere to the contract terms if the contract specifies a longer notice period. Previously, the exemption was capped at an amount equivalent to the employee&#8217;s last 300 days&#8217; wages, up to a maximum of THB 300,000. However, the updated regulation now allows for an exemption of up to the employee&#8217;s last 400 days&#8217; wages, with a new cap of THB 600,000.<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-lzjp1r3j-ad9246edef82795e05b76cf38285fe26'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">The new tax exemption rate applies to assessable income received from January 1, 2023, onward. If an employer violates this act, they can be fined between THB 5,000 to THB 200,000 and\/or imprisoned for up to one year. The following situations are considered wrongful dismissals: immediate dismissal without a clear and full explanation, termination of the agreement without just cause or severance pay, termination of the agreement without payment of unused annual leave, and termination based on a claimed violation of work regulations without prior warning.<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-lfhzqsj7-d449932a7916a89e4456e454528d6cf3'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">Employees who wish to file a wrongful dismissal claim with the Labour Court must provide evidence that one or more of their legal rights were violated due to the termination. Section 49 of the Act on the Establishment of and Procedure for Labour Court states that if the Labour Court finds the dismissal unfair, the employer must reinstate the employee at the same wage level as before the dismissal.
