The following activities are considered as \u2018selling\u2019 under the act:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">selling,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">dispensing,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">distributing,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">exchanging,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">or giving the substance to others.<\/span><\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-mc2tu0s9-a7a32462522741c95e6605d00b919bff'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">The Kratom Plant Act prohibits the sale of Kratom leaves (or food that contains Kratom leaves as an ingredient) to:<\/span><\/p>\n<h4><\/h4>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">anyone under 18 years old, and<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">pregnant or breastfeeding women.<\/span><\/li>\n<\/ul>\n<h4><\/h4>\n<p><span style=\"font-weight: 400;\">The Kratom Plant Act also allows the Ministry of Justice and the Ministry of Public Health to prohibit selling Kratom to additional persons at a later date.<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-mc2tu7x0-9b50292c7017adbb6d319e9fa89ce84c'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">Any one who sells Kratom must post an announcement at their place of sale (including electronic points of sale) stating that the groups listed above are prohibited from purchasing Kratom. Anyone caught selling Kratom to these groups or failing to post the required announcement or notice could be subject to a fine of up to THB 30,000.<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-mc2tug9p-0291d09fac4787c07a8bca81a12c657e'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">Please note that selling Kratom to the restricted groups above may be allowed only if done for medical or educational purposes. Medical or educational purposes are defined as follows:<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-mc2tut8r-9e77ea7f949d934374ffe824b5cc2f05'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Treatment of disease, therapy, or relief of illness under the supervision of a medical practitioner, dental practitioner, Thai traditional medicine practitioner, or traditional medical professional under the law related to the Thai traditional medical profession; or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Study, analysis, or research carried out by a government agency that is responsible for conducting medical, pharmaceutical, or scientific research or education, or providing medical, pharmaceutical, or scientific services for the benefit of medical or pharmaceutical, Thai Red Cross Society, or educational institutions.<\/span><\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-mc2txuhm-f2a0f192d762127c2b8d9bf58f292b70'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><h4><b>Are there any other restrictions to selling Kratom?<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">In additional to the restrictions listed above, it is also prohibited to sell Kratom in the following locations:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">educational institutions,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">dormitories,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">parks,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">zoos,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">amusement parks,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">vending machines,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">or other places specified in announcements by ministers of the Ministry of Justice and the Ministry of Public Health.<\/span><\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-mc2tye59-f7d8c9069beb1ef426852967de0f2470'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">Should anyone be caught selling Kratom in these locations, they may be subject to a fine of up to THB 50,000, and up to twice that (i.e., THB 100,000) if the sale is to one of the prohibited parties mentioned above.<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-mc2typx0-6dd4e5c44fbb6c8d1d0b7e5d19ea3853'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">While the consumption of Kratom is now legal, it is still prohibited to consume Kratom leaves mixed with narcotic drugs, psychotropic substances, dangerous substances, or any other substance specified by the Ministry of Justice. The exception to this being when done for the specific medical or education purposes given above. Under the Act, the advertising or promotion of the consumption of Kratom leaves mixed with narcotics or psychotropic substances, drugs and dangerous substances, or other designated substances is prohibited. This regulation covers advertisements or any type of marketing communications such as:<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-mbt4tf93-d4c7974eaf21f40d4dc5fab67eaf765c'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">public relations,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">news,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">publishing promotion,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">point-of-sale displays,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">direct marketing,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">sales,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">and online or computer advertising.<\/span><\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-mc2u00ie-c81cbde48103c3bffdb312d22a469aae'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">Any form of advertising or promotion which violates the Act is subject to imprisonment for a period of up to two years, a maximum fine of THB 200,000, or both.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Furthermore, anyone or any advertising\/promotion that aims to convince others (including \u201cencouraging, deceiving, intimidating, improperly influencing, or forcing\u201d) to consume Kratom leaves mixed with narcotic drugs, psychotropic substances, dangerous substances, or other designated substances is also prohibited. The Thai shareholder must not be a nominee as the Foreign Business Act prohibits the use of Thai shareholder nominees.<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-mbt4vlh4-80e4d6f1a33d9d2dbeebcc71a620c571'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">A nominee shareholder can be described as an individual who:<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> Lacks genuine interest in the business.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> Has made no significant investment in the company.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> Lacks the financial means and skills to be a legitimate partner.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> Exists solely to facilitate foreign participation in restricted businesses.<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-mc2ue3un-2ad5f127a156091a1697bf7175d493d2'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">For instance, appointing an unskilled Thai worker with a modest income as a majority shareholder in a company with substantial registered capital while simultaneously denying them voting and dividend rights would be considered as using a nominee shareholder.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A private limited company that has been properly structured is the most common business type for a Kratom business.
