Act B.E. 2562 (2019) (PDPA) came into full effect. The PDPA regulates how a data controller or a data processor collects, uses, discloses, and\/or transfers personal data, and provides a safeguard against abuses of the right to privacy of a data subject.<\/p>\n<p>Failure to comply with the PDPA could result in civil, criminal, and\/or administrative penalties handed to the offending party.<\/p>\n<\/div><\/section><\/p><\/div><div who has the power to make decisions relating to the collection, use, disclosure and\/or transfer of personal data.<\/p>\n<p>A <strong>Data processor<\/strong> is a person or a juristic person who collects, uses, discloses and\/or transfers personal data on behalf of another party who is the data controller.<\/p>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" text_16'  itemprop=\"text\" ><p>Civil penalties may be sought against an offending party when a data controller or data processor fails, intentionally or negligently, to comply with the PDPA\u2019s requirements.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4sbwt7i-7507940bc17fb25c5d5a3513c20a85fe'  itemscope=\"itemscope\" a situation, they can claim actual compensation from the data controller or the data processor. Examples of actual compensation, all actual expenses spent by the data subject used to prevent or avoid such damage.\u00a0<\/span><\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4sbx6x7-f9a6d1a45dba6b6b2594964cf9dbefbe'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>Additionally, should the data controller\/processor be found to be in breach of the PDPA, the court has the ability to sentence the data controller or data processor to pay punitive damages to the data subject in addition to the actual compensation.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4sbxioz-09db5cf81b47f2cca7a5a03c4f36e205'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>Punitive damages are limited and must not exceed two times the amount of the actual compensation.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4sbxs65-fca2c94a1334bfe8a996069ecf66118c'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>The statute of limitations for claiming civil compensation due to breaches of the PDPA is three years from acknowledgement of the breach and the identification of offenders by the data subject, or ten years from a wrongful act by the data controller or data processor.<\/p>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-l4nm6w6s-dd08f44ee4465207ff3d56352d59c2dd\">\n#top .hr.hr-invisible.av-l4nm6w6s-dd08f44ee4465207ff3d56352d59c2dd{\nheight:5px;\n}\n<\/style>\n<div  class='hr av-l4nm6w6s-dd08f44ee4465207ff3d56352d59c2dd hr-invisible  avia-builder-el-24  el_after_av_textblock  el_before_av_textblock  av-medium-hide av-small-hide av-mini-hide'><span class='hr-inner '><span class=\"hr-inner-style\"><\/span><\/span><\/div><br \/>\n<section  class='av_textblock_section av-l4nm16x2-4a776203a243c88cf6dacf3e13b324f1'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock h2_bleu_post'  itemprop=\"text\" ><h2>Criminal penalties<\/h2>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4nm1qu9-6394fae2bf6522681d29e8bdf94c4f26'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>Breaches of the PDPA can result in criminal penalties being enforced due to the following actions:<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4pd7uxe-fa0605432bcdb16842198d7683804c50'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><strong>Scenario 1<\/strong><\/p>\n<p>If the data controller:<\/p>\n<ol>\n<li>uses or discloses personal data without the consent of the data subject where consent is legally required, or<\/li>\n<li>receives personal data from another data controller and uses or discloses this personal data for purposes other than the purposes previously informed to the disclosing data controller, or<\/li>\n<li>sends or transfers sensitive personal data to a foreign country that does not have an adequate data protection standard without other legal exceptions.<\/li>\n<\/ol>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4sbzgri-b9bc57ce616c62a56a80ff8dfa9d257b'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>If the scenario above is found to have occurred, these actions must have been made in a manner that is likely to cause the data subject to suffer any damage, impair the person\u2019s reputation, or expose the person to be scorned, hated, or humiliated. If this is found to be true, the data controller could face a punishment of imprisonment for up to six months, or fine up to 500,000 Baht, or both.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4sbzsmn-2b9ad80c68e7007af4a5ec153d9acf8a'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>If the data controller commits any of these acts in order to receive unlawful benefits (for themselves or others), the data controller may be punished with imprisonment up to one year, or fine up to one million Baht, or both.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4sc0avj-fd2f0b48ba2b91387cc04fd845f32738'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><strong>Scenario 2<\/strong><\/p>\n<p>If any person obtains the personal data of the data subject as a result of performing duties under the PDPA and then discloses this personal data to any other unauthorised person, they may face a punishment of imprisonment up to six months, or fine up to 500,000 Baht, or both.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4sc0mgg-53f8da39f0cb29e557f51460efa9d4e7'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>However, there are certain circumstances in which these actions are permitted. For example, where the disclosure of the information is in the interest of investigation procedures, proceedings by the courts, or the data subject provided written consent.<\/p>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-212g4t-e4bb02348d89ec8decdcd2c2e3f05b01\">\n#top .hr.hr-invisible.av-212g4t-e4bb02348d89ec8decdcd2c2e3f05b01{\nheight:30px;\n}\n<\/style>\n<div  class='hr av-212g4t-e4bb02348d89ec8decdcd2c2e3f05b01 hr-invisible  avia-builder-el-32  el_after_av_textblock  el_before_av_textblock  av-medium-hide av-small-hide av-mini-hide'><span class='hr-inner '><span class=\"hr-inner-style\"><\/span><\/span><\/div><br \/>\n<section  class='av_textblock_section av-kzm67b1a-21fb519746f09bd2a842cd536a0e5f12'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock h2_bleu_post'  itemprop=\"text\" ><h2>Administrative penalties<\/h2>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-kz3ijvlt-fad395277747ea0d37394e6df0d77409'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>Administrative penalties may apply to the data controller or the data processor, or any person who violates any of the PDPA\u2019s provisions.<\/p>\n<p>Administrative penalties consist of a monetary fine of up to five million Baht.<\/p>\n<p>The Personal Data Protection Committee (PDPC), has power to issue administrative fines by taking the following into consideration:<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4doz2ah-b02f2328d3f77c87a429168a1d8c416c'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><ul>\n<li>the level of severity of non-compliance,<\/li>\n<li>the business size of the data controller or the data processor,<\/li>\n<li>or other relevant circumstances as deemed suitable by the PDPC.<\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4sc243k-06e01bb442e83355bf0d17446bc91a13'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>Administrative penalties may be enforced for the following breaches of the PDPA:<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4sc2slp-3acd98754d1bdbe6613bd247e0d61ee7'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>An administrative fine of <strong>up to one million Baht<\/strong> can be issued for the following:<\/p>\n<ul>\n<li>The data controller does not inform the data subject prior to, or at the time of the collection about the following requirements; purpose of the collection, retention period, categories of persons to whom the collected personal data may be disclosed to.<\/li>\n<li>the data controller does not record information in the record of processing activities (ROPA); or<\/li>\n<li>the data controller or the data processor does not appoint the data protection officer (DPO) where it is required by the PDPA.<\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4sc3tkh-e7e9f74c43450c3434d7bf1c4156dbdb'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>An administrative fine of up to <strong>three million Baht<\/strong> can be issued for the following breaches:<\/p>\n<ul>\n<li>the data controller processes personal data other than for the purpose informed to the data subject;<\/li>\n<li>the data controller collects, uses, and\/or discloses personal data without the consent of the data subject;<\/li>\n<li>the data controller does not inform the the Office of Personal Data Protection Committee of any breaches within 72 hours of becoming aware of the incident;<\/li>\n<li>the data processor does not inform the data controller about any known breaches.<\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l4sc4lob-ea69cca042dad3e62c36d61a2f3543b7'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>An administrative fine of <strong>up to five million Baht<\/strong> can be issued for the following breaches;<\/p>\n<ul>\n<li>the data controller collects, uses, and\/or discloses sensitive personal data without the explicit consent from the data subject or without another applicable legal basis;
