The transfer of personal data does not include sending personal data through an intermediary by transiting between computer systems or internet networks, or any storing\/retaining of personal data, either permanently or temporarily, through a cloud computing service provider, whereby the personal data transferor and the personal data recipient (1) are not making the order, (2) are not involved with any data selection or the content of the personal data sent and received through the computer systems or internet networks, or (3) have the purpose of entering into an agreement or any juristic act.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l93y88bc-c308e3bd63d0072a2c9600f6863822bc'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><strong>\u201cBinding corporate rules\u201d<\/strong> are the agreed terms or policy on personal data protection entered into by the personal data transferor and the personal data recipient in order to establish appropriate measures for safeguarding personal data within a group of corporations or companies.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l93y8m8i-89ac6259257605c95546af1b08ae475b'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><strong>\u201cStandard contractual clauses\u201d<\/strong> are the contractual terms that govern the personal data transferor and the personal data recipient to create the appropriate measures for safeguarding personal data.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l93y90ct-6752c26b36042f97b344100d3ecf4245'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><strong>\u201cCode of conduct\u201d <\/strong>is the code that sets out the obligations of a personal data transferor and a personal data recipient outside of Thailand.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l93y9f3t-c471f202983efa249bf26d37790fb853'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><strong>\u201cCertification\u201d <\/strong>refers to the creation of appropriate personal data safeguarding measures.<\/p>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-1tysb5-6a613440456c9d8d951b4d2a0faceaae\">\n#top .hr.hr-invisible.av-1tysb5-6a613440456c9d8d951b4d2a0faceaae{\nheight:30px;\n}\n<\/style>\n<div  class='hr av-1tysb5-6a613440456c9d8d951b4d2a0faceaae hr-invisible  avia-builder-el-23  el_after_av_textblock  el_before_av_textblock  av-medium-hide av-small-hide av-mini-hide'><span class='hr-inner '><span class=\"hr-inner-style\"><\/span><\/span><\/div><br \/>\n<section  class='av_textblock_section av-l5td29qs-01a9d1eb3da5365882e3d2f262259d1d'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock h2_bleu_post'  itemprop=\"text\" ><h2>Binding Corporate Rules<\/h2>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l6k8wic2-e70031dbf15d6c249e47f4643c049c89'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>For cross-border transfers that are made within a group of corporations or companies, binding corporate rules (BCRs) can be established by these groups and submitted to the PDPC for approval.<\/p>\n<p>These Binding Corporate Rules must adhere to the following minimum standards:<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l93yaitu-3a0d21bb17b6d8e526ac30887b67f036'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The effectiveness and legally binding nature of the BCRs must apply to each company or entity within the group. This includes the data recipient, data processor, and data transferor, and the members belonging to the group, as well as their employees, staff, or persons related to the transfer or receipt of personal data within the group.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The BCRs must comply with Thai laws on personal data protection.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The BCRs must contain certification of data subject rights under the PDPA and sub-regulations.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The BCRs must contain measures on personal data protection in relation to the following: personnel, processes, and security measures. These measures must be in accordance with the required technology standards for personal data protection.<\/span><\/li>\n<\/ul>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-8iju8g-712dbd91ef927a4e2dfc837a757ed696\">\n#top .hr.hr-invisible.av-8iju8g-712dbd91ef927a4e2dfc837a757ed696{\nheight:30px;\n}\n<\/style>\n<div  class='hr av-8iju8g-712dbd91ef927a4e2dfc837a757ed696 hr-invisible  avia-builder-el-27  el_after_av_textblock  el_before_av_textblock  av-medium-hide av-small-hide av-mini-hide'><span class='hr-inner '><span class=\"hr-inner-style\"><\/span><\/span><\/div><br \/>\n<section  class='av_textblock_section av-38bn5n-a4c27684c17c4e3ed8f785188999a111'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock h2_bleu_post'  itemprop=\"text\" ><h2>Appropriate Safeguards<\/h2>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l8wt2zcc-73c333e39f0d5422e71ed1276dc701fe'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>Under section 29, paragraph 3, of the PDPA, a personal data transferor may transfer personal data to a recipient outside of Thailand when procuring appropriate safeguard measures by way of \u201cstandard contractual clauses\u201d, \u201ccode of conduct\u201d, or \u201ccertification\u201d.<\/p>\n<p>Such appropriate safeguards must at least ensure the data subject\u2019s rights are legally enforceable and effective legal remedial actions are available.<\/p>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l93ybjpu-d4b5e2be61069101a0e8c9c102fea3dd'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p><span style=\"font-weight: 400;\">The notification states that the appropriate safeguards must include the following:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Effectiveness and legal enforceability.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Compliance with Thai laws on personal data protection.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Certification of data subject rights under the PDPA and sub-regulations.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Measures on personal data protection in relation to personnel, process, and security measures in accordance with the required technology standards for personal data protection.<\/span><\/li>\n<\/ul>\n<\/div><\/section><br \/>\n<section  class='av_textblock_section av-l93yc0m7-28df19a9115bc1a67ed9f93e8941b36f'  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock text_16'  itemprop=\"text\" ><p>All standard contractual clauses must be filed with the PDPC. The appropriate safeguard measures must provide the data subject with legal rights that are also enforceable under Thai law. These rights must also provide remedial rights for data subjects as stipulated under Thai law.<\/p>\n<\/div><\/section><br \/>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\"
